In consideration of being allowed to participate in any way in Blake Bortles Foundation Football Performance programs, related events and activities, the undersigned acknowledges, appreciates, and agrees that: The risk of injury from the activities involved in this program are significant, including the potential for, but not limited to, falls, slips, sprains, broken bones, contact with other players, paralysis, sudden death, potholes, standing water and other conditions of the field, along with, humidity, heat, cold, and other weather conditions inherent to training and conditioning. And while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for my child's participation. I certify that I AM OF THE AGE THAT MYSELF AND/OR MY PARENT OR LEGAL GUARDIAN HAS STATED ON MY APPLICATION; and that this waiver remains in full force and effect until specifically revoked in writing. I willingly agree to comply with all of the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my participation, in or near my presence, I will remove myself from participation and/or proximity of the hazard and bring it to the attention of the nearest official immediately. In consideration for being permitted to engage in the above listed camp, I, on behalf of myself, my child and/or my ward, hereby grant Blake bortles Foundation, Inc., and their respective parent companies, affiliates, subsidiaries, assigns, and advertising and promotional agencies (collectively, the "Authorized Parties"), the right to photograph and videotape me, my child and/or my ward (each a "Participant"), at the above-identified activity ("Activity") held at the Oviedo High School Football Fields at Oviedo High School and the right in perpetuity to use, copyright, and publish all images and recordings and any reproductions thereof (collectively, the "Material") for any lawful use and for the purpose of publication, publicity, advertising, or trade, in any manner and in any medium. I acknowledge, on behalf of each Participant, that, except as provided above, no Participant will be receiving compensation from any of the Authorized Parties or any other person or entity for the use of the Material, and no Participant shall have the right to use, own or copyright any of the Material. In further consideration, I, on behalf of each Participant, release and forever discharge the Authorized Parties, and each of them, from any and all claims, demands, causes of actions, suits, damages, costs and expenses (including, without limitation, attorneys' fees and court costs) for any and all personal and/or property injuries incurred by any Participant in connection with the Activity (each a "Claim"), and forever release and discharge the Authorized Parties, and each of them, from any and all Claims, actions and demands arising out of or in connection with the participation of any Participant in the Activity. I recognize and acknowledge, on behalf of each Participant, that participation in the Activity, or related rehearsals, is at the sole risk of a Participant, and understand that this waiver and release of liability is absolute as to any Claim which may arise as a result of participation by any Participant. This document shall inure to the benefit of the assigns, licensees and legal representatives of each of the Authorized Parties. The undersigned further acknowledges that this release is governed by and intended to be as broad and inclusive as permitted by the laws of the state of Florida. If any portion of this release is held invalid, it is agreed that the balance hereof shall continue in full force and effect. COVID-19 Assumption of Risk: 1. I am aware that the novel coronavirus ("COVID-19") is an extremely contagious virus and that it is currently believed that COVID-19 spreads through person-to-person contact. 2. I am familiar with the Center for Disease Control and Prevention ("CDC") guidelines regarding COVID-19, which are located at https://www.coronavirus.gov and https://www.cdc/gov/coronavirus/2019-ncov/index.html. I acknowledge and understand that the circumstances regarding COVID-19 are changing from day-to-day, and that the CDC guidelines are regularly modified and updated. I accept full responsibility for familiarizing myself with the most recent updates, and making informed choices to take precautionary measures to protect myself and others. 3. In addition to the CDC guidelines, I agree to abide by any and all policies or postings published to the general public at the Facility. 4. By signing this agreement, I acknowledge that I am aware of the contagious nature of COVID-19 and voluntarily assume the risk that my children and I may be exposed to or infected by COVID-19 at the Facility, and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Facility may result from the actions, omissions, or negligence of myself and others. 5. I agree that, in the event that I suspect I became exposed to or infected by COVID-19 at the Facility and I elect to seek testing and/or treatment as a result therefore, I will be responsible for payment of any and all medical services and testing services. 6. I voluntarily, choose to assume all of the foregoing risks and accept sole responsibility for any injury, illness, permanent disability, or death related to COVID-19 arising from or in connection with my presence at the Facility. I hereby release and hold harmless the Facility, their employees, agents, directors, officers and representatives and than other participants from and against all liabilities (statutory or otherwise) for claims, suits, demands, judgements, costs, interest and expense (including but not limited to attorney's fees and disbursements) for injury, illness, permanent disability, or death related to COVID-19 arising from or in connection with mine or my child(ren)s presence at the Facility. EVEN IF ARISING FROM THE NEGLIGENCE, ACTS OR OMISSIONS OF THE RELEASED PARTIES. I have read and fully understand this document, including the provisions relating to the waiver and release of participant claims, and acknowledge that I am over the age of 18 and am authorized to fully bind each minor participant to the terms of this agreement. I, for myself, and on behalf of my heirs, assigns, personal representatives, and next of kin, HEREBY RELEASE AND HOLD HARMLESS. Blake Bortles Foundation, camp site host, their agents, assistants, volunteers, medical personnel, officers, employees sponsoring agencies sponsors, advertisers, owners or lessors of any premises used to conduct the event (known herein as RELEASEES), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss, or damage to person or property, WHETHER ARISING FROM NEGLIGENCE OF THE RELEASEES OR OTHERWISE. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT. I FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT. AND I SIGN IT FREELY WITHOUT ANY INDUCEMENT.
